Stafford Township - Stafford Business Park Diversion application amendment
Back in June of 2006, when the MOA was signed by Stafford Township, the Ocean County Board of Chosen Freeholders and the New Jersey Pinelands Commission for the redevelopment of the Stafford Business Park property a requirement was placed that after its proper capping, the landfill portion would be deed restricted for open space.
The deed restriction, which in December 2006 was filed, states “that the Restricted Area be forever protected and preserved in its natural, scenic, open and existing state free from all activities that might damage, compromise or interfere with the ecological diversity, natural beauty or resource quality, or with the natural processes occurring.”
The release of the restricted area required a NJ Green Acres Diversion application. The application originally submitted by Stafford Township (click here to review documents) did not include off-set land as replacement for the diverted landfill/open space portion of the site. The application was accepted by NJ Green Acres and then approved. PPA litigated the approval of the application. The courts have remanded the application back to NJ Green Acres and Stafford Township which has resulted in the amended application being filed. This new application includes off set land at a 1:1 ratio.
